Why it matters

Where entities are subject to income tax (UAE corporate tax, Egypt CIT, or a taxable foreign-ownership share in KSA), years of accumulated unrealized fair value gains on investment property build up a deferred tax liability that is easy to under-recognize, and the rate applied depends on a specific judgment about whether the asset's value will be recovered through sale or through continued rental - getting this wrong misstates both the tax charge and the effective tax rate reconciliation investors rely on.

Diagnostic questions

Which group entities are subject to income tax (UAE CT, Egypt CIT, a taxable foreign-ownership share in KSA) versus zakat-only? For each fair-valued investment property, is the sale presumption applied by default, or is there clear evidence rebutting it in favor of recovery through use? Is deferred tax recognized on the cumulative gap between accounting revenue recognized to date and revenue recognized for tax purposes, where developer revenue timing differs? Are zakat computations kept separate from income-tax-based deferred tax computations across differently-regulated group entities?

Recognition

1) Identify which entities in the group are subject to income tax versus zakat-only (pure Saudi/GCC-owned KSA entities are typically zakat payers outside the scope of IAS 12 deferred tax) and map the applicable regime entity by entity (UAE corporate tax, Egypt CIT, mixed-ownership KSA entities). 2) For investment property carried at fair value in a taxable entity, determine the temporary difference between the carrying amount and the tax base. 3) Apply the rebuttable presumption that the carrying amount of fair-valued investment property will be recovered through sale, and use the tax rate/base that would apply on sale, unless the entity can rebut this - for example where the business model is clearly to hold the property to earn rentals over its economic life with no intention to sell, which would instead use the tax consequences of recovery through use (rental). 4) Recognize deferred tax on developer revenue timing differences where tax recognizes revenue on a different basis (cash, invoicing, or handover) than the accounting basis (over time or point in time under IFRS 15). 5) Recognize deferred tax assets for deductible temporary differences and tax losses only to the extent future taxable profit is probable. 6) Do not blend zakat computations with income-tax-based deferred tax computations across differently-regulated group entities; keep them separate and specialist tax input should confirm each entity's regime and rate.

القياس

Measurement

Measure deferred tax at the tax rate(s) expected to apply when the temporary difference reverses, consistent with the expected manner of recovery (sale rate/base versus rental/use rate/base) determined per the presumption analysis above, applied on an undiscounted basis as required by IAS 12. For developer revenue timing differences, measure the deferred tax on the cumulative difference between accounting revenue recognized to date and revenue recognized for tax purposes to date, at the rate expected to apply when that difference reverses (typically at handover or completion for tax purposes).

Presentation & disclosure

Disclose the effective tax rate reconciliation, the components of deferred tax assets/liabilities (including the investment property fair value temporary difference and developer revenue timing differences), the recovery-manner judgment applied and whether the sale presumption was rebutted, and the split between zakat-based and income-tax-based entities within the group where both exist.

Common mistakes

1) Not recognizing any deferred tax on years of accumulated fair value gains on investment property in a taxable entity, effectively ignoring the temporary difference entirely. 2) Ignoring the recovery-manner analysis and defaulting to a rental-use tax rate without evidence that actually rebuts the sale presumption. 3) Blending zakat-only KSA entities with income-tax-paying UAE or Egypt entities into a single group deferred tax computation instead of assessing each regime separately. 4) Missing deferred tax on developer revenue timing gaps where tax recognizes revenue on handover but accounting recognizes it over time under IFRS 15. 5) Using the wrong tax rate (e.g., a general corporate rate) when the jurisdiction imposes a different specific rate or basis on real estate capital gains versus rental income.

Simple example

Facts: A UAE landlord subject to 9% corporate tax holds an investment property at fair value. Carrying amount at year end is AED/SAR-equivalent SAR 200,000,000; tax base (original cost) is SAR 120,000,000, giving a taxable temporary difference of SAR 80,000,000. The property is part of a long-term rental portfolio, but management has not rebutted the sale presumption (no specific evidence that recovery will be entirely through use with no eventual sale), so the deferred tax is measured using the rate/base that would apply on sale, at the 9% corporate tax rate.
Journal entry to recognize the deferred tax liability (SAR 80,000,000 x 9% = SAR 7,200,000):
Dr Deferred tax expense (P&L) 7,200,000
   Cr Deferred tax liability 7,200,000
If in a later year the entity obtains clear evidence rebutting the sale presumption (e.g., a board-approved long-term hold strategy with no sale contemplated and the applicable tax law taxing rental income differently from capital gains on sale), the deferred tax would be remeasured prospectively using the rental-recovery tax consequences, with the adjustment recognized in profit or loss in the period of the change in judgment.

Professional judgment

The recovery-manner presumption (sale versus use) is rebuttable only with clear, specific evidence - a general statement of 'long-term hold intent' is usually not enough on its own if the entity has a demonstrated pattern of selling investment properties or no binding restriction against sale. Jurisdiction mapping (which entities are zakat-only, which pay UAE corporate tax, which pay Egypt CIT, and which KSA entities have a taxable foreign-ownership share) is a factual and legal question that changes as ownership structures and tax laws evolve, so specialist tax input is advisable rather than relying on prior-year conclusions by default.
